Terms & Conditions
Please ensure you read these Terms and Conditions carefully before booking your course with us. These terms detail who we are, how we will provide our services to you, how you and we may amend or terminate the contract, what to do in case of issues, and other significant information. By booking and having your booking accepted by us, you agree to be legally bound by these Terms and Conditions.
Definitions
- We/Us/Our: Refers to Beauty Science Academy.
- You/Your: Refers to the person receiving our services and responsible for payment.
- Course: Refers to face-to-face or online courses or training sessions provided by us.
- Business Day: A day other than a Saturday, Sunday, or public holiday in England when banks in London are open.
- Services: Refers to beauty courses and masterclasses, including any related materials provided or purchased.
Note: “Writing” includes emails, Facebook, and WhatsApp messages.
- These terms
- These are the terms and conditions on which we supply our Services to you such as Courses.
- Our acceptance of your booking of the Course will take place when we tell you that we are able to provide you with the Services, which we will also confirm to you, at which point a contract will come into existence between you and us.
- If we are unable to accept your booking, we will inform you of this in writing and will not charge you. This might be because there is no available space on the Course you have submitted your booking for.
- Bookings
2.1 We will process and acknowledge all booking requests within 2 business days.
2.2 You must be at least 16 years old to attend our courses.
2.3 Bookings can be made via email, phone, or text message.
2.4 A non-refundable deposit is required to reserve your place on the course.
2.5 Bookings are confirmed on a first-come, first-served basis upon receipt of the deposit.
2.6 Full payment must be received no later than 3 business days before the course commencement date to confirm your place.
2.7 If you wish to amend your booking, please contact us to ascertain if the change is possible and discuss any necessary price or schedule adjustments.
2.8 We reserve the right to make minor changes to the course content or venue where necessary.
- Payments and Price
3.1 The price will be confirmed in writing when you make your booking.
3.2 Full payment must be made no later than 3 business days before the course start date.
3.3 We may cancel your booking and allocate your place to another customer if full payment is not received.
3.4 Non-refundable deposits will not be returned if your booking is cancelled due to non-payment.
3.5 Late payments may incur an interest charge of 5% above the base lending rate.
- Course Attendance
- You must arrive at the training venue promptly, in any event at least 15 minutes before the start time as stated on the booking confirmation.
- If you arrive more than 15 minutes after the scheduled start time we reserve the right not to allow you to enter the Course session. This will have to be re-booked and re-scheduled at an additional cost to be paid by you and Course completion and certification cannot be awarded until such time.
- Course dates are subject to change or cancellation at any time without any liability to us and where an alternative date cannot be offered within a reasonable time a full refund will be given to you within 30 Business Days.
- Online Sessions
6.1 We will provide the required materials for the course.
6.2 Some courses may require you to bring your own equipment or products.
6.3 Equipment and products may be available for purchase from us.
6.4 Home study and practice are expected outside of course hours.
6.5 Some courses may require you to bring your own model.
6.6 Lost or stolen course materials can be replaced for a fee.
6.7 We are not responsible for lost or stolen course materials.
- Course Materials and Resources
- We will provide the materials required to complete the Course.
- For some of the Courses you will be required to bring your own equipment and/or products with you to the Course. We shall inform you in advance if you require to bring your own equipment and/or products.
- You might be able to purchase the equipment or products from us subject to availability.
- You will be expected to complete home study and practice in your own time. Materials and equipment will not be provided for this.
- For some of the Courses you will be required to find and bring your own model for the practical side.
- In most of the time Academy providing you with Working Materials (books, notes etc.) please note that if your book has been lost or stolen you can request another book for additional charge of £10 per book.
- Academy do not take responsibility for any lost or stolen course materials.
- Health & Safety
- We are committed to ensuring that all our students and staff work in a safe and healthy environment, fully supported by safe working practices and adherence to all relevant legislation, best practices and industry regulations.
- You will be supervised whilst using the equipment.
- All students are required to dress in appropriate and comfortable clothing. No jewellery to be worn except for wedding bands.
- Mobile phones must be switched off in the training room or left on silent.
- If you are pregnant speak to an advisor before booking, as some Courses may be unsuitable. A signed disclaimer must be signed by you if you choose to attend any Course whilst pregnant.
- You must inform us of any special requirements at the time of booking. If any new issues arise after your booking has been confirmed, you must notify us immediately before/during the Course;
- If you require us to provide a model, this must be requested and paid for (additional charge) when booking the Course. If you intend to bring a model, you must notify us of this at least 5 Business Days before the Course commencement date.
- Assessments
- Where an assessment is part of your Course, you will need to attend this on the date stated in your Course confirmation. Any request to change this date must be made at least 21 Business Days before the Course start date. Failure to attend and successfully complete the assessment will result in certification not being issued.
- Certification
- All our certificates issued by us will have to be collected from us on the arranged date and time.
- It is your responsibility to ensure that your details are accurately spelt as we will not be held responsible for any errors or omissions on your certificate where these details are incorrect. (please note if you have had misspelling on your name).
- An administration charge will apply to replacement certificates.
- Cancellations under the Consumer Contracts Regulations 2013
- For the Services booked off our premises, as a consumer you have a legal right to change your mind within 14 days after the day we email you to confirm we accept your booking and receive a refund under the Consumer Contracts Regulations 2013. However, once we have completed the Services you cannot change your mind, even if the period is still running. If you cancel after we have started providing the Services, you must pay us for the Services provided up until the time you tell us that you have changed your mind.
- To end the contract with us, please either call us or write to us.
- If you are entitled to a refund under these terms we will refund you the price you paid for the Services by the method you used for payment. However, we may make deductions from the price, as described below.
- We may deduct from any refund an amount for the supply of the Service for the period for which it was supplied, ending with the time when you told us you had changed your mind. The amount will be in proportion to what has been supplied, in comparison with the full coverage of the contract.
- Your refund will be made within 14 days of your telling us you have changed your mind.
- Privacy Policy & Personal Data
- All personal information you provide to us will be kept private and confidential.
- We will use the personal information you provide to us to:
- provide the Services;
- process your payment for Services; and
- if you agreed to this during the booking process, to inform you about similar products that we provide, but you may stop receiving these communications at any time by contacting us.
- Where we extend credit to you for the Services we may pass your personal information to credit reference agencies and they may keep a record of any search that they do.
- We will only give your personal information to third parties where the law either requires or allows us to do so.
- Liability Limitation & Disclaimer
- All our Courses are delivered professionally to the highest standards and our commitment to you is to provide a professional Service.
- Course dates and class numbers are subject to change at any time and we reserve the right to make minor alterations to our Course content or duration as we deem appropriate. No refunds will be given in these circumstances.
- In the event that we deem it necessary to cancel a Course we will provide a full refund.
- If our performance of the Services is affected by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any Services you have paid for but not received.
- If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
- We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation.
- Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Services, we can still require you to make the payment at a later date.
13. Intellectual Property
- For the purposes of this clause 14, Intellectual Property Rights means all training programmes, training materials, lectures, slides, handouts, training methods, recordings, workshops, patents, rights to inventions, copyright and related rights, trademarks, service marks, trade, business and rights in goodwill or to sue for passing off, topography rights, moral rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world.
- We have spent considerable time and costs in the development of our Services and processes and all the information which we provide in relation to our Services and in the materials, including but not limited to information provided orally, in writing or electronic form and delivered in lectures, practical sessions, discussions, workshops, webinars, seminars and training sessions. You acknowledge and agree that such information and materials is confidential in nature and contain valuable trade secrets, technical and commercial know-how, specifications, inventions, processes and initiatives. You shall not make or permit the making of any copies, reproductions, recordings, interpretations or analysis of Course materials or resell the materials to any party.
- All Intellectual Property Rights in or arising out of or in connection with the contract and in our materials shall be owned by us and you have a licence to use our materials for your own personal use and during the time we provide our Services to you.
14. Amendments to the contract terms and conditions
- We will have the right to amend the terms and conditions of this contract where we need to do so in order to comply with changes in the law or for regulatory reasons; or we need to correct any errors or omissions (and this right includes the right to change any of the documentation which forms part of the contract), as long such correction is minor and does not materially affect the contract. Where we are making any amendment we will give you as much notice as is possible.
- A person who is not a party to this agreement shall have no rights under the Contract (Rights of Third Parties) Act 1999 to enforce any of its terms.
